### 1. general information

**1.1** The famido App is an online portal operated by famido AG (hereinafter "famido").

**1.2** Use of the famido app and the benefits listed on it is subject to these General Terms and Conditions (GTC), which are deemed to have been accepted upon registration.

**1.3** The version of the GTC published on famido.ch shall apply. famido may amend or change the GTC at any time at its own discretion. The latest version of the GTC shall apply.

**1.4** These GTC exclusively govern the contractual relationship between famido and the users of the online portal as defined above. Any contractual terms and conditions of partners that conflict with or deviate from these GTC shall not be recognized unless famido has expressly agreed to them in writing in individual cases.

**1.5** famido reserves the right to change or completely discontinue the services offered at any time. The information contained in the famido app may also be partially or completely changed or deleted at any time without prior notice.

**1.6** famido also reserves the right to make adjustments to the famido smartphone app, but does not undertake to provide updates.

**1.7** With regard to the data processing carried out by famido AG, reference is made to the privacy policy.

**1.8** famido AG uses personal data to maintain customer relationships and for marketing purposes. Users have the option of prohibiting automatic evaluations. If the user does not wish to receive automatic personalized evaluations, he/she can refuse this in writing.

### 2. definitions

**2.1** A "user" is a person who has registered in the famido app and created a profile, providing all the necessary information. The services of famido can only be used by users.

**2.2** "Partners" are companies that appear on the famido app with a benefit.

**2.3** A "benefit" is a non-specific advantage offered by a famido partner in any form on the online portal. This can be a generally valid discount or a benefit that is only offered to famido users. famido offers the following different types of benefits:
a) Discounts
b) Competitions
c) In-store cashback
d) Online cashback

### 3. registration and access authorization

**3.1** Families with at least one child under the age of 10 or future families with a child on the way are welcome to use famido.

**3.2** To create a famido account, it is necessary to provide the gender, first and last name, a telephone number, the postal code and place of residence, an e-mail address and the age of the child.

**3.3** A person/family can only have one account with famido.

**3.4** In order to be able to use in-store cashback offers, at least one means of payment must be deposited.

**3.5** The information provided by the user during the registration process must be truthful. Should a user fail to do so, famido expressly reserves the right to reject the user's registration.

**3.6** Users are also obliged to check the data in their account regularly and to update or supplement it if necessary. At the request of famido, the accuracy of the data provided by users must be verified. famido reserves the right to carry out spot checks on the accuracy of the data provided.

**3.7** Users are generally welcome as long as they have at least one child under the age of 10 or one child on the way.

**3.8** Once a user profile has been created, it is personal and may not be shared or passed on to other persons (the user profile is in this sense personal and non-transferable). The user undertakes to keep his/her password safe at all times, to protect it from misuse by third parties and to keep it secret.

**3.9** Misuse of the information accessible on famido.ch or the famido app is expressly prohibited.

**3.10** Violation of these GTC may result in the deletion of the account. famido reserves the right (in particular in the event of fraud or attempted fraud) to initiate civil and criminal proceedings and/or to support its partners in such efforts.

### 4. Utilization of benefits and identification as a user

**4.1** Users can identify themselves as such via the famido app. Logged-in users can access and redeem benefits (subject to availability) via the app. Benefits that can be redeemed on a daily, weekly, monthly, quarterly or one-off basis require users to go through the confirmation process and, where applicable, meet other criteria.

**4.2** Benefits must be redeemed via the app by or in front of a responsible employee of the respective partner. If no employee can verify the redemption of a benefit via the smartphone, the partner is not obliged to grant the benefit.

**4.3** If the redemption of Benefits via the smartphone is not possible for technical reasons - in particular if vouchers cannot be reliably validated - the Partner is not obliged to grant the Benefit.

**4.4** Once a Benefit has been redeemed, it cannot be renewed outside the specified availability cycles. famido will not reactivate the Benefits if they have been redeemed by mistake and the Benefit has not been granted by a Partner. Any resulting mutual legal claims between user and partner must be clarified between them: famido cannot be held liable or responsible for this.

**4.5** Benefits can be deleted, changed, supplemented or otherwise adapted at any time and without prior notice.

**4.6** Partners may make the granting of benefits dependent on additional conditions, such as, for example, that benefits relating to the performance of a product can only be offered for as long as the product is in stock.

**4.7** Partners are obliged to adhere to the benefits agreed with them for the period agreed with them.

### 5. participation in competitions

**5.1** Users may participate in competitions posted on the famido app.

**5.2** The winners will be notified by e-mail. In doing so, famido may insist that the user provides famido with his/her address and, if necessary, other data to enable delivery of the prize and/or other relevant information. This data may be sent to the partner awarding the prize so that they can contact the winners directly. Should this be the case, famido will inform the winner and give him/her the opportunity to object.

**5.3** If it is explicitly stated in a competition that the data of participating users may be forwarded to the organizing partner, the user agrees by participating in the competition that his/her contact details (in particular e-mail address) may be forwarded to the relevant partner.

**5.4** If famido does not receive any feedback from the user within 24 hours of the notification of the prize being sent, or if the user's address details are not sufficiently visible to famido, a new winner may be determined without further notification.

**5.5** A cash payment or exchange of prizes is excluded in any case.

**5.6** Partners are obliged to provide the prizes agreed with them by the agreed deadline.

**5.7** Apple Inc. has no connection with the competitions or prize draws.

### 6. cashback

**6.1** The famido app offers in-store cashback and online cashback.

**6.2** In-store cashback is only available from the partners marked accordingly in the famido app and the amount of in-store cashback may vary from partner to partner. The amount of the in-store cashback can be adjusted at any time in consultation between famido and the partners and the user has no claim to past in-store cashback offers.

**6.3** The crediting of in-store cashback is subject to the following conditions:
(a) the User fulfills the characteristics of a User in accordance with Clause 2.1 at the time of the transaction and its crediting.
(b) the user has completed a transaction with a partner who offers valid in-store cashback in the famido app at the time of the transaction.
(c) the user has stored the means of payment used for the transaction in his user account and therefore agrees that the data required for the provision of the aforementioned service will be forwarded to us via the Worldline One Link Service ("WOL") after the transaction made with a partner has been recognized.

**6.4** Online cashback is only available from the partners marked accordingly in the famido app and the amount of online cashback may vary from partner to partner. The amount of the online cashback can be adjusted by the partner at any time and the user is not entitled to past online cashback offers.

**6.5** Online Cashback is made possible through cooperation with networks that provide tracking. This cannot be influenced by us. The cooperation works via affiliate marketing, whereby the conditions of affiliate marketing are based on the contractual agreements between famido AG and the affiliate network, a service provider of the partner companies.

**6.6** The crediting of online cashback is subject to the following conditions:
(a) at the time of the transaction and its crediting, the user fulfills the characteristics of a user in accordance with clause 2.1.
b) the user has completed a transaction with a partner who offers valid online cashback in the famido app at the time of the transaction.
c) the user has accessed the partner website via the famido app
d) the user has accepted all cookies on the partner website
e) the user has not used any other discount codes that cannot be combined with Online Cashback
f) the user has not used any add blockers or similar technologies
g) the tracking process was not disturbed by accessing other websites in the meantime or due to settings on the user's end device.

**6.7** The following conditions apply to subsequent bookings of online cashback:
a) The duration of the processing time depends on the partner.
b) The partner decides whether the subsequent booking is accepted or rejected.

**6.8** If cashback transactions are reversed (e.g. due to a complaint or reversal of the transaction), the corresponding cashback will be deducted. famido may also deduct credited cashback in other justified cases (e.g. card misuse or incorrect charges).

**6.9** The cashback can be canceled by famido (i.e. the cashback expires) if the user violates the General Terms and Conditions, the conditions for receiving the cashback are not or no longer met, the user has deleted his account or has not used the famido app for more than 12 months. The account will then be reset to CHF 0.

**6.10** The following provisions apply to famido's Spinning Wheel campaigns:
a) The probability distribution on the prize wheel does not correspond to the frequency of the multipliers on the prize wheel. It is not the case that all multipliers are drawn with the same probability.
b) Campaigns can be activated and deactivated at any time.
c) In order to activate the Welcome Cashback, a valid means of payment must be deposited in the app within three months.
d) A user can only participate once per campaign. This also applies if he deletes his account and creates a new one.

**6.11** The user can view the current balance of the cashback in his user account, if necessary with a certain time delay.

**6.12** Cashback does not bear interest.

**6.13** The accumulated cashback amount can only be paid out from a confirmed amount of CHF 60 and only to a valid Swiss bank account of the user. The payout can be initiated via the famido app. Fees and costs of the recipient bank are borne by the user.

**6.14** famido is exempt from the payment obligation if the bank account specified by the user is assigned to another person or does not exist. The account will then be reset to CHF 0.

**6.15** The account will also be reset to CHF 0 if the account is deleted, which is the case, for example, if the general requirements for being a user are not or no longer met.

**6.16** In the event of bankruptcy or the threat of bankruptcy, famido is exempt from the obligation to pay out.

### 7. warranty and liability

**7.1** Although famido endeavors to publish only correct and up-to-date information, all information on famido.ch, the famido smartphone app and in the newsletters is provided without guarantee (exclusion of any warranty rights).

**7.2** A benefit not granted by a partner cannot be claimed from famido under any circumstances. Any legal claims must be addressed directly to the partner with whom an independent legal relationship is entered into.

**7.3** famido shall only be liable for damage caused intentionally or through gross negligence. Liability for damage caused by auxiliary persons is hereby excluded to the extent permitted by law.

**7.4** famido endeavors to provide its users with access to famido.ch and the associated smartphone app without technical faults. However, maintenance and further development work on the website and disruptions of a different nature may temporarily interrupt the use of famido.ch or the famido app. famido shall not be liable for damages (including loss of profit and loss of data) resulting from technical restrictions on use or failures of the platform. In particular, liability for damages resulting from loss of data is excluded.

**7.5** Technical access (internet connection, etc.) to the app system via the platform and the corresponding services is the responsibility of the user. The Provider assumes no liability for the network operators and rejects any liability for the hardware and software required to use the app system to the extent permitted by law.

**7.6** All links to external providers are checked for accuracy at the time of inclusion. However, famido shall not be liable for making external content accessible or for any consequential damage resulting from the inclusion of links to third-party websites. It is irrelevant whether the damage is of a direct, indirect or financial nature or whether there is any other damage that may result from data loss, loss of use or other reasons. famido hereby expressly distances itself from the content of all linked websites.

**7.7** The user acknowledges that all goods and services listed on the famido app are produced or offered by partners and not by famido itself. famido therefore provides no manufacturer's warranty and shall not be liable for any damage arising in connection with the use of a product or service offered by a partner. Any claims must be addressed directly to the partner in question.

### 8. mobile use

**8.1** When using famido.ch via smartphone, additional costs may be incurred for data transmission, depending on the mobile phone contract.

**8.2** The availability of content in the mobile network depends on the network coverage on the respective mobile device or access to the Internet.

### 9. copyright

**9.1** famido and the respective partners retain all copyrights and other rights to content, images and other types of information published on famido.ch or the famido app. This information may only be reproduced, redistributed or used in any other copyright-relevant form with the written consent of famido or the partner in question.

**9.2** The copyright for the design of the famido.ch website and the famido smartphone app lies with famido.

### 10. severability clause

**10.1** Should individual provisions of these GTC prove to be invalid, the remaining provisions shall continue to apply. An invalid provision shall be replaced in good faith and in a legally effective manner by a provision that comes closest to the economic purpose of the invalid provision.

**10.2** Only the German version of these General Terms and Conditions shall be legally binding. The English, French or Italian translation has no legal effect and cannot be used to interpret the German text.

### 11. choice of law and place of jurisdiction

**11.1** This contract shall be governed by Swiss law to the exclusion of international conflict of laws rules and any international conventions.

**11.2** The place of jurisdiction shall be the registered office of famido AG.

### Special conditions in connection with the implementation of the CSS Kranken-Versicherung AG competition

Conditions of participation in the competition
The closing date for entries is stated on the famido.ch/css/win page. Participation is only possible online via the famido application (famido.ch/css/win). Entries by post, e-mail or other means will not be considered. The prize draw is open to anyone resident in Switzerland, with the exception of employees of the CSS Group and their relatives. Participation is free of charge and is not linked to the conclusion of a legal transaction. The winners will be notified personally. The prizes will not be paid out in cash and will not be exchanged. No correspondence will be entered into regarding the prize draw. Legal recourse is excluded. Participants agree that their details may be used by the CSS Group for marketing purposes and that they may be contacted by telephone in particular. If you win, you may be disclosed to third parties as the winner. Competition prizes are subject to change.
